OVERVIEW

Welcome to BRISA! The terms “we”, “us” and “our” refer to BRISA. We operate this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). BRISA is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (the “Terms”), describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, do not use or access our Services.

Nothing in these Terms limits your statutory consumer rights under applicable EU or Dutch law, including your right of withdrawal for online purchases.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence, or that you have given us your consent to allow any of your minor dependents to use the Services on devices you own or control.

To use the Services, including browsing our store or purchasing products, you may need to provide certain information such as your email, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity on your account. You may not transfer or assign your account to any other person.

SECTION 2 – OUR PRODUCTS

We make every effort to display accurate product descriptions and images. However, colors and appearance may vary depending on your device and settings. We do not guarantee that product images reflect the exact appearance of the item received.

All product descriptions and pricing may be changed or updated at any time without notice. We may limit quantities or discontinue products at our discretion.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We may accept or reject your order at our discretion. Your order is accepted only when we send an order confirmation.

Once an order is accepted, it may not be possible to cancel it. If we reject or modify an order, we will attempt to notify you using the contact details provided at checkout.

Your purchases are subject to our Refund Policy.

You represent that items purchased are for personal use and not for resale.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price applicable to your order is the price displayed at checkout at the time of purchase.

Unless stated otherwise, prices do not include VAT (where applicable), shipping, customs duties or import taxes.

You agree to provide accurate and up-to-date payment and contact information so we can complete your transactions.

You represent and warrant that:

1. payment details you provide are true and authorized,

2. your payment provider will honor charges, and

3. you will pay all amounts due, including taxes and shipping.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. While delays may occur due to carriers, customs, or events outside our control, BRISA remains responsible for ensuring that your order is delivered to you in accordance with EU consumer law.

Risk of loss or damage transfers to you only when you (or a person designated by you) physically receive the goods, unless you selected your own independent carrier that we did not offer.

Nothing in this section affects your statutory EU consumer rights regarding delivery and conformity of goods.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services—including text, images, logos, graphics, videos, and design—is owned by BRISA or its licensors and is protected by Dutch, EU, and international intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, modify, display, or distribute any content without our prior written permission.

All BRISA trademarks, logos and brand elements are proprietary to BRISA. Shopify trademarks belong to Shopify. Other marks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools which we neither control nor monitor. You acknowledge that such tools are provided “as is” and “as available” without warranties or liability.

Your use of third-party tools is at your own risk and subject to the providers’ own terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or policies of any third-party sites. Accessing such websites is at your own risk.

Please review the third party’s own terms and policies before engaging in any transaction with them.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

BRISA is powered by Shopify. However, all sales through our store are made directly with BRISA. Shopify is not responsible for transactions between you and BRISA. You expressly release Shopify from all claims arising from your interactions with BRISA.

SECTION 10 – PRIVACY POLICY

All personal information you provide is governed by our Privacy Policy.
Because our store is hosted on Shopify, certain personal data will be processed by Shopify as described in their own privacy policy.

By using the Services, you acknowledge this data processing.

SECTION 11 – FEEDBACK

If you submit reviews, feedback, suggestions or ideas (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and share such Feedback for any purpose.

You represent that you own the Feedback and that it does not infringe any third-party rights.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain errors relating to pricing, descriptions, promotions, shipping charges or availability. We reserve the right to correct such errors or cancel orders affected by inaccuracies.

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including liability for intent, gross negligence, or for death or personal injury caused by our negligence.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless BRISA and Shopify from claims arising from your breach of these Terms or violation of any law.

SECTION 18 – SEVERABILITY

If any provision of these Terms is deemed unlawful or unenforceable, that portion shall be severed, and the remainder will continue in full force.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any right under these Terms does not constitute a waiver.
These Terms, together with our posted policies, constitute the entire agreement between you and us.

SECTION 20 – ASSIGNMENT

You may not assign your rights under these Terms without our written consent. We may assign our rights at any time.

SECTION 21 – GOVERNING LAW AND JURISDICTION

These Terms of Service are governed by the laws of the Netherlands.

Disputes may be brought before the courts of Amsterdam, the Netherlands.
If you are an EU consumer, you may also bring proceedings in the courts of your country of residence pursuant to EU consumer protection laws.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect the interpretation of these Terms.

SECTION 23 – CHANGES TO TERMS

We may update or modify these Terms at any time. Material changes will be communicated as required by law. Continued use of the Services after changes constitutes acceptance.
